Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Friday AI platform, websites, and related services (collectively, the "Service"), operated by Friday AI LLC ("Friday AI," "we," "us," or "our"). By creating an account, completing a purchase, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Friday AI provides a software platform for real estate professionals that includes lead capture, contact management, messaging and follow-up automation, pipeline tracking, appointment scheduling, campaign tools, and related features. We may add, modify, or remove features at any time. The Service is provided for business use, not personal or consumer use.
2. Accounts and Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account. If you use the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
3. Subscriptions, Billing, and Renewals
The Service is sold on a subscription basis with monthly and annual billing options. By purchasing, you authorize us and our payment processor to charge your payment method the subscription fee, plus any applicable taxes, on a recurring basis. Subscriptions renew automatically at the end of each billing period at the then-current rate unless cancelled before renewal. Usage-based costs — including SMS, voice, and email sending fees — may be billed in addition to the base subscription where applicable. Prices may change with notice; changes take effect at your next renewal.
4. Cancellations
You may cancel your subscription at any time through your account or by contacting [email protected]. Cancellation takes effect at the end of the current billing period, and you retain access to the Service until then. We may suspend or terminate accounts for non-payment.
5. Refunds

6. Acceptable Use
You agree not to use the Service to violate any law or regulation; send spam or unsolicited communications; harass, defraud, or mislead any person; upload malicious code; attempt to gain unauthorized access to the Service or other users' data; resell or sublicense the Service except as expressly authorized in writing; or interfere with the operation of the Service. We may suspend or terminate accounts that violate this section.
7. Messaging and Communications Compliance
You are solely responsible for the communications you send through the Service. This includes compliance with all applicable communications laws and carrier requirements, including without limitation the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and text-messaging laws, Do-Not-Call registry rules, and applicable carrier messaging policies (including A2P 10DLC registration requirements). You represent that you have obtained all legally required consent from every recipient before sending them calls, texts, voicemails, or emails through the Service, that you will honor opt-out requests promptly, and that you will maintain records of consent. We may suspend messaging capability for accounts that generate carrier violations, excessive complaints, or apparent non-consensual outreach. You agree to indemnify us for claims arising from communications you send.
8. SMS Messaging Terms
Friday AI LLC operates the Friday AI software platform and messaging program.
Users who separately consent to SMS communications may receive account notifications, onboarding communications, appointment reminders, customer-support messages, billing or service notifications, product updates, educational information, and occasional promotional offers from Friday AI LLC.
Message frequency varies. Message and data rates may apply.
You may cancel SMS communications at any time by replying STOP. After you reply STOP, Friday AI may send one final confirmation that you have been unsubscribed. You will not receive additional text messages unless you provide consent again.

Wireless carriers are not responsible for delayed or undelivered messages.
Consent to receive marketing or promotional text messages is not required as a condition of purchasing Friday AI products or services.
Friday AI customers are independently responsible for obtaining legally sufficient consent before using the Friday AI platform to text their own leads, customers, sellers, buyers, or prospects. Purchasing Friday AI does not give a customer permission to contact any person by SMS.
Mobile telephone numbers, SMS opt-in information, and messaging consent will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.

9. Customer Data
You retain ownership of the data you upload to the Service, including your contacts, leads, and communications ("Customer Data"). You grant us a license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for having the legal right to upload and use your Customer Data, including any personal information of your leads and clients. Our collection and use of personal information is described in our Privacy Policy.
10. Third-Party Services
The Service interoperates with third-party services such as telephony carriers, email providers, calendar systems, and payment processors. We do not control third-party services and are not responsible for their availability, performance, or terms. Your use of a third-party service is governed by that provider's terms.
11. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by Friday AI LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription for your internal business purposes. You may not copy, modify, reverse engineer, or create derivative works of the Service.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR BUSINESS RESULT, INCLUDING ANY NUMBER OF LEADS, APPOINTMENTS, OR CLOSED DEALS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
14. Indemnification
You agree to defend, indemnify, and hold harmless Friday AI LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Customer Data, your communications sent through the Service, or your violation of these Terms or applicable law.
15. Termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay fees when due, or use the Service in a way that creates legal or operational risk. Upon termination, your license to use the Service ends. Sections that by their nature should survive termination — including Sections 5, 7, 8, 9, and 11 through 16 — will survive.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to their jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
